What is the name of your state (only U.S. law)? New York, NY

How does suing someone (a U.S citizen) for not paying back a loan work if that person is out of the country working, and won't be back for say about a year.

Does the court force them to return? Or does the court grant them a year extension until they get back home?

Thanks!
