Summer Parenting Time

What is the name of your state (only U.S. law)? MI

Our order says each parent shall be afforded 3 weeks summer parenting time (only 2 weeks consecutive). Dad (NCP) to provide Mom (CP) with notice of his dates by May 1 of each year.

Dad gave me dates yesterday. His intent is to take three weeks straight, regardless of my pointing out what the order says. He will only budge if I "give him more time."

What should I do to prevent this from happening? Can I do anything beforehand to prevent it, or would I be viewed as inviting trouble before it came since he has not yet kept our son for three straight weeks?

What do the orders say happens if dad does not give you his dates by May 1st? Does he forfeit his time if he doesn't notify you by that date? Do you get to choose his dates?

You tell dad firmly but politely that he is required to follow the orders, and if he does not do so, that you will take him to court for contempt. Then do so if he disregards the orders.

You should keep one thing in mind though, if those orders were made when the child was much younger, its possible that dad could file to modify the summer visitation so that he gets half of the summer. Unless there are fitness issues he would almost be guaranteed to receive that.

I will tell Dad clearly what you mention, but I suspect it will fall on deaf ears. To clarify what I understood from your reply LdiJ, I will have to let Dad take our son for the three weeks straight and then react by contacting the court. Is this correct?

He won't be in contempt until he actually does it...AND you actually attempt to retrieve the children after two weeks.

I'd urge you to carefully consider whether this is a hill worth dying on. How does it negatively impact THE CHILD to spend 3 consecutive weeks w/father rather than 2?

My order is written that ex and I swap kids every 2 weeks for the summer. However, this year, it worked out best for us to each keep the kids for 6 weeks at a time. The kids are not being harmed, it works out better for the grownups, but it's technically not what the court ordered. It's abou doing what works for the FAMILY even if that FAMILY is no longer intact.
