What is the name of your state?MN
I responded within time frame to a summons from lawyer for CA. I'm waiting to get I guess the next round of instructions from the court (case not filed yet), but this debts never been validated and doesn't the plaintiff have to validate it in a court hearing instead of just telling the court so and so owns me this amount of money and the judge saying I guess they do so judgment for the plaintiff. Also, anyone know what's going to happen next and any kind of time frame. I had to have my answer in by 4-25 and I did. Thanks.

What did you file as an answer? Have you begun to conduct discovery?

In court, there is no "validation" in the context it is used by the FDCPA. Your job is to make the plantiff prove everything. You do that through discovery.

I suggest that you spend some time on the message board at www.creditinfocenter.com. You will find lots of conversation about discovery.

Also, just a tip -- the judge is not there to look out for your interests. The judge will only consider the facts that are brought to his/her attention through the filing of motions.

I put down lack of knowledge and in MN that's the same as a denial. I'll go to that web site and see if I can find out how to conduct discovery. If I don't see anything, when is that supposed to start and what should I do now. Thanks so much.
