I received papers for modification filed by my daughters father. New thing, he was fired from this job (the $300 gross weekly job that he quit the $45,000 a yr job to work for) and cannot get unemployment (which leads me to think he was fired for a reason..Last yr same time he quit his job for this job ( but was not successful in getting it lowered except the 3 months he was out for his knee surgery). We just got finished with the last modification trial in June/July.

Anyone ever see or hear of any experiences where the NCP got it lowered after being fired in NY? He didnt say why he was fired though so i dont know.

He lists why it should be lowered because he was fired and cant get unemployment (he was there over the 28 week mark so he was there long enough he must have done something to fire him and not get unemployment). He also states he cannot afford to support his immediate family (im assuming the wife and kids again). Also he says hes in "dire straights and loosing everything" (he has that luxery of having a house, if he has hard time paying for it with those 3-4 bedrooms, sell it and get an apt or maybe wife can help pay for her kids or their dad. Where he lives and where his step kids live is not my problem or his, its their parents problem. I share an apt with family members to make my ends meet.

Also its being seen by a different magistrate (ive never dealt with this one yet) so im just hoping she doesnt fall for his garbage. I'm filing a cross motion to violate him for the uncovered medical costs he ignored. Also someone told me that he will have to appear in person for the violation petition is this true? Hes always been able to appear by telephone. He lives about 4-5 hrs away so doesnt bother me either way was just curious cause I dont want to walk outside the court alone if he does have to appear. Hes the type to accuse me of something.
