I am 6 months behind on my child support, the mother of my 2 kids has agreed for me to give up my rights. I am trying to find out If i give up my rights will i still be obligated to pay child support, what happens to what i am passed due that I pay thru the friend of the court?

It doesn't work that way. Although you can give up any rights to see your child, you do not get to walk away frmo your obligation to support him/her. The only way that is likely to happen is if your ex is remarried and her current husband is willing to adopt the child - and actually does so. Even if that should happen, unless she waives the arrears (which she can only do if none of the arrears are a result of her being on state aid) - you will still owe them and interest will accrue until they're fully paid off.

Why haven't you been able to pay your support?

Wow, I just made a very similar post. My sons mother has agreed with me that if i sign over rights that she will stop all future child support payments.

Although she is recently married, it is still about 11 more months before the step father is eligable to adopt, and even then the question is will he agree to it.

So I would like to know if she has the power to stop the future payments immediately when I "sign over my rights"? This is what we have both agreed to in a calm, adult manner, and would like to get this "show on the road".

But knowing DHR and the courts and whatnot, are they going to make this difficult or if not impossible?
