taking children out of state

What is the name of your state? IL

This is funny. I have sole custody of my 2 kids ages 10 and 6. My ex has contacted a lawyer reguarding me taking them out of state and not telling him the address of the places we go. (and a few other issues of course). He never stops filing things in civil court. So, my question is do I have to notify him even if we are only in another state for less than 72 hrs? Or do I legally have to tell him if we cross state lines for 2 mins? The state statue is very vague. I thought that I didnt have to disclose that unless we are gone longer than 72 hrs.

And this letter , It says I need to contact him directly about these matters. So, I'm guessing he hasn't hired this law firm as of yet, that it's just a "scare" tactic to get me to give in to his demands?

Unless your court order actual states that you have to notify him of any out of state trips, you can stay gone as long as you want without notifying him about anything, as long as it doesn't interefer with HIS visitation time.

Particularly since she has sole custody.

BB, you said that is incorrect? Then I have to notify everytime I leave state even if its for a cpl hrs?

May a parent remove a child from Illinois temporarily, such as for vacation?
Before a minor child is temporarily removed from Illinois, the parent responsible for the removal must inform the other parent, or the other parent's attorney, of the address and telephone number where the child may be reached during the period of temporary removal, and the date on which the child will be returned to Illinois.

First, she has sole custody. Second, she is not leaving for more than 72 hours at a time nor causing him to miss any visitation. Therefore this is a petty action on dad's part.

However, if its just for a day, she definitely doesn't have to notify him of anything.

I didn't write this, I took it from an Illinois guideline site.
I don't necessarily agree, but this is what it said.

On another note, if not an overnight visit, OK, why bother, but for an overnight, it's kind of responsible to inform the other parent.
CO or not.
We took kiddos 1.5 hours away for a weekend, in state, but I stiil let the youngest Dad know we'd be away and where.

My question is why WOULDN"T you tell the other parent where you are going with the children? ( I mean what is the big deal, other than you think that they are trying to control you somehow.) Is where you are going some big dark secret?

They can't attend school!

I don't know...just popped into my head for some reason.

OP, just avoid this and let Dad know when your taking the kids away.
That way, should you get kidnapped while away, someone knows to come looking for you and where.
