taping phone conversations

Is it legal for a parent to tape phone conversations between him and our child? Last week our daughter was talkinmg to hre father for maybe a minute she heard a beep then her voice being played back, she aked him if he was rcording their conversations and he said no. She then said I just heard my voice being played back and she hung up on him. He was caught! He then called back again and left a message stating" I dont know why a 10 year old would think that I am recording her" . He then said " Who would tll you tht I m recording you". Well I did not her the conversation nd she ws in the other room this is what she told me. I beleive that he was recording her becuse he use to have his co-workrs listen in on there conversations until the day tht she confronted him on the concussion tht she received from him, he quit his job that day. We are in a custody bttle at the moment and I do think that he will use the children as much as possible and what they say. My girls tell him nothing anymore.

Consent of one party is required to record telephone and radio communications.

Face-to-face conversations may be recorded if the participants are informed that their conversation is being recorded.

Violation is a misdemeanor.

Cordless telephone conversations are protected under state law.

Nope. Not unless they are able to give informed consent. You cannot give consent for them.
 
They wants everything recorded, but I said no because I thought it was illegal. During our last court battle he stated in front of the Judge that he does not record because it is illegal.

Let's try this explanation from a different angle:

He can record because HE is the "one party" and he is an adult.

You cannot record your child's conversations with him because she is not an adult and cannot give consent.

You can record your calls with Him because you are an adult and can give consent- Likewise he can record his calls to you for the same reason. So the person recording must be an adult who is actually one of the people IN the conversation.
