When I was divorced 2 years ago my ex was making over 300K year and was ordered to pay 400wk child support & 400wk alimony. He was given the tax deduction because he earned the most money. He never paid the alimony from day one. Soon after he claimed he was not earning this amount of money and after being in contempt for 16 months, they made him pay back alimony in the amount of 20k. But they also believe that he is not earning as much as he had and took away the alimony and reduced the child support to 100wk.
The judge states in her decision that he lied about everything including deceiving the IRS but get this one......she believes him about his earnings. I later find out that this judge has been suspended numerous times for unethical practices (doing lawyers favors).
My question how difficult will it be to file for a modification for me to claim my son since I now am earning a decent wage and fully supporting my son. I have full physical & legal custody due to Dad's abusive and controlling behavior.
