What is the name of your state?What is the name of your state? Arizona.
I need help. My daughter, her boyfriend and their child live with me. The boyfriend is 17 and wants to say with us and be with his daughter. Both of his parents are in court to decide who has custody of him. It boils down to who pays support to who. I am supporting him. Can a court make him return to either of his parents home with him wanting to remain with our family. Should the child support that is going to his mother be going to me. Both parents know where he is and do nothing to support him in a financial or emotional way. I feel that he should not fear being removed from my home where his daughter lives.

I dont know the law in Arizona but the same situation happened with a friend in Virginia. In Virginia You had to actually have custody if it's not your child to recieve support. If he is 17, he is underage so he has to go back to the parent with physical custody, unless he get emancipated.

It's extremely likely that he's going to have to go back to live with one of his parents. A judge is not likely to be overly impressed with your decision to allow an underage child who has impregnated your daughter (you don't say how old SHE is) live under your roof over the objections of his parents.

Answer to question

My daughter is 17. Her boyfriend's dad will not let him live with him and the mother is abusive. CPS has been called and will not react. The father picked-up the boyfriend at my home on Saturday drunk. It is a very unsafe place at both of the homes.

I don't know the laws in Arizona either but, I'd instruct the boy to get a job (That is if he doesn't already have one) then take him to an attorney to file for emancipation. Again, I'm sure there are other stipulations with this kind of thing so you may want to gather as much information as you can on the subject before proceeding.

Both parents are working and A students in High School. I also make them take parenting classes. I am the only source of stability that the boy has. We have very strong rules in the home, that is the only way that he can live here. We are 5 months from his 18th birthday and his parent don't do anything to parent him. They just fight over who pays support to who. It is a very sad situation.

But unfortunately, you are not his mother. So unless the court gives you custody, you have no dog in the fight and could potentially find yourself in legal trouble.
