My landlord might lose his property. He is fighting to hold onto it as we speak. My lease ran out last year. But we continue to stay, on verbal agreement. If the bank takes over? What are our options. If I understand what I've read. We have thirty days to leave. And are still responsible to pay rent. Does the winter months give us a right to stay? I know utilities can not shut you off in the winter months. Can we be forced to leave? Now all we got was a notice to quit. What steps are left in the process. My landlord has a lawyer and was going to sell the place to his dad. Infact he himself has no place to go. I just want to be prepared for what could and should happen next. I have kids and have to think about them. If we are evicted and can stay thru the winter are we responsible for rent, and if we don't pay then what?

Yes you have to pay rent if not to the landlord then to the bank, and if you dont pay you will be evicted.

And yes you will be evicted the day before christmas a sheriff will come and put your stuff to the street.

Dont you people ever watch "Roger and Me" by Roger Moore?

He detailed his hometown closing of a GM plant in flint Michigan, and one of the characters was a sherrif evicting a family to the curb on xmas eve becuase they BS'd the landlord in court and didnt pay so the landlord went back to court got the sherriff to kick them to the curb....all over less then $400 .......

So SUNDAY get the newspaper and LOOK for a new place to live....what is the problem here?

In most states, the bank taking property back is a BREAK in the chain of title so you would not be given a 30 day notice - just a notice to be out and then the sheriff. This is really a state specific situation depending on the type of foreclosure that the bank utilizes.

You should be getting monies together and find a new place asap. Also realize that any deposit your current LL may have is probably gone.

I'm not a free loader. I pay my rent early every month for the past three years. And if you believe eveything you see in the movies, you are even more of a pathetic loser then you have proven by some of your other comments to other people. I have not heard one postive or constructive thing come out of your mouth on any body's questions. All you do is bash other people. Makes me think you have some inadequateness. And the only reason I would be evicted is because the bank is taking over and is selling the property to low income. Which I make to much to stay. Maybe you could get in?

Thank you for some constructive advice. We are putting together some monies. I Just was trying to see what steps are left in the process, and how long I would have. We haven't been served any eviction notice. Just a notice to quit. Some one told me they were different. I think I'll contact the local sherriff and ask him. I think I'll try and research some local laws too. I also figured so much on the security. If the LL cannot hold his property, then I fugure my money is gone.

A Notice to quit is just that...a notice to quit living on the premisis by a certain date.

If you are still there then they can start evcition proceedings in court.

Winter means Nothing..kids mean Nothing..by law.

BUT.....If you went to court after eviction papers are served on you,the Judge could make a deal with the bank to let you stay as long as you paid the rent. Iffy prospect but you never know untilyou try.

as far as the security did you pay this months rent?

What is the date of the notice to quit, be out by what date? And who wrote it? The landlord the laywer the bank?

You could try and hustle the landlord, by having him sign an agreement to use your secuirty as next months rent.At least that way you wont lose all of it... it all depends on the dates of the notice and when you paid the rent
