YOU are free to give anyone any information at all. No release is needed when YOU are providing the information.

You could file a complaint to the effect that the doctor failed to get your signature on a release, but given that you DID give him permission, it's going to be a moot point. You cannot use that to force the employer to give you, your job back. At best, the doctor will get a slap on the wrist and told to be more careful next time.

I think you are correct. I definitely don't want the doctor to have any trouble over this, and it looks like she would be the only one that would be affected. That is pretty much what I assumed when I start4ed this inquiry. I found some additional answers, the affirm this on a few other websites.

Man, you just can't help with the snide comments. You really seem fancy yourself an authority. I'll bite. Like you said what? What is the answer. The answers you provided don't even take the laws I'm inquiring about into consideration. We haven't discovered any absolute in this matter. We have an assumption, which you and I both agree on, but it's an assumption. I'm not a privacy attorney. I don't know if you're an attorney, if you're researching the actual code, if you're just stating an educated, or uneducated guess, or if it's just ignorant assumption like mine.

If you tested positive for THC, it can stay in your blood for 30 or so days.
If you tested positive for anything else, it would indicate that you had used within a very limited timespan (1-3 days).

It goes to the veracity of your interest in seeking help. It goes to showing your commitment to getting "clean".

Give the answer, don't give the answer---no skin off my back.

(but you gave verbal permission to the MD to share your information...you probably don't have a leg to stand on in court.)
