i was involved in an accident while test driving a used car, i did not know it was uninsured. even though the accident was caused by the other party speeding, technically i was at fault and the other car probobly was totald. i understand i can be personally sued because of this, however unqualified friends have told me its more likely the owner of the uninsured car will be sued.

if i do get sued i have no money to pay with, and my only valuable property is the 3.5k car i bought, which is my transportation to school and work.

so i guess my questions are these:
how likely is it i will be sued and what can they take? is there some sort of payment plan for these sort of things?

Uninsured coverage

if the vehicle that you were driving did not possess a viable policy of insurance, than be prepared that you may be required to answer for the damages caused.. The lack of insurance prevents you and the owner from relying on an insurance carrier to pick up the defense and indemnify the Plaintiff if there is any monetary award. That is if you are sued of course.. the driver's lawyer, in all likelihood will file a claim for uninsured motorist benefits through the driver's own policy. If this happens, than you are open to a claim being made against you on behalf of the driver's insurance company who had to pay their insured for your negligence. This is the path of least resistance for Plaintiff's lawyers to collect on behalf of their client. In a nutshell you may both be sued.. How do you know you were even at fault?

a judgment against you is good forever. your wages can be garnished and accounts can be frozen.. sounds to me like y ou are judgment proof having little to no money.. they are certainly not going to take your car.. its not worth the time for any lawyer.. chances of being sued by Defendant are slim due to availability of monies thru the uninsured motorist coverage. Couldnt tell you the likelihood of the insurance company looking to you for reimbursement through subrogation.

How's that basement your living in? Its really ok that you just havent been able to make any scratch in this business..its a shame that this forum doesn't pay cause you could take a nice retainer from any poster that is willing to take your advice and sarcastic undertones...must help you maintain good client rapport..or are you simply your boss' lackey? hmmm its almost 11 so i best get back to "the village" ..P.S.. not a judge..civil service just doesnt pay enough. Given that my "basement" is worth more than the trailer you're from, then I suppose you have a point. But thanks for confirming that you're not a judge, I never would have guessed :rolleyes:
