What is the name of your state? texas
I have e-mailed these questions to the TWCC and some lawyers on-line and have not received a response can you help me?
Can an employer dictate to the employee a specific time or a time frame
that the employee can seek medical attention (as in doctor's appointment's or physical therapy)for an injury that has occurred on the job?
Can an employer initiate disciplinary action against an employee for seeking medical attention?
Please e-mail me back and please include documentation
Thank you

Is your employer a subscriber thru the state of Texas? Do they have a workers comp policy? If you answer yes, to either of these questions, even if you have it in writing, double check it. If your employer is a subscriber thru TWCC then your claim will be governed by their rules. You can read all of these rules online at their website. You only have ONE year from the date of injury to file a claim if it is truly workers comp. If they do not have work comp and are "going bare", then you will have to seek and attorney and take up a personal injury claim against them. You only have TWO years to file a personal injury claim against them. You should also check out the insurance company to make sure they are a legimate business. You can do this at the Texas Dept of Insurance website. Also in Texas, your employer is required by law to let you know whether or not they have work comp insurance. I hope this helps. I wish you all the luck in the world as you will need it.

FAIR IS FAIR

gd78758, your company can ask that you schedule appointments (personal or work-related injury) so that they cause a minimum amount of interruption to the workday. I am not aware of any law that addresses this issue so no documentation or link but you may want to check your company policies regarding this.(This has nothing to do with your company being a subscriber or non-subscriber to workers' comp.)

They cannot retalitate against you for sustaining a work-related injury and/or seeking treatment for the injury.
