<than half of my $1595 deposit deducted?

What is the name of your state?Is it legal for us, the ex-tenants, to ask the landlord for receipts that will prove that the apartment I moved out from was painted prior to my move-in date, or that any other repairments were done to it? The landlord claims that the unit was in a certain condition before we moved in. The landlord sent us a letter stating each repairment done to the unit, when we moved out. According to the landlord the unit was in a specific state and because of this, we were charged to get the unit re-painted, etc., because "supposedly" the unit was painted prior to our move in date.

I don't agree with their claims. Especifically that the apartment was painted prior to me moving in.

This is the reason why I would like proof ( bills, receipts ) that the work they claim was actually done to the apartment. I am out of the apartment, now, and out of my $1595 deposit, I will only receive 761.00. In my opinion, the landlord is charging me for repairments that did not occur prior my move in date.

Please Advise me!!!

P.S. I live in Santa Cruz California.

Of course its legal for your to ask for them. And it is just as legal for the landlord to refuse.

In order to try to force them to provide records and/or to prove their claims, you will have to file a lawsuit, presumably in small claims court.

One other thing.... from your post, it appears that the landlord MAY have been in violation of other requirements of landlord-tenant law in California. I suggest you read Section 1950.5 of the Ca Civil Code at:

Sounds like

It sounds like to me depending how long you lived there that the landlord is charging you for normal wear and tear which he may not be able to do (not sure of CA) and if he is then it is illegal. Take him to small claims court. sounds like he wants free money. IMO too many landlords feel entitled to keep deposits no matter what
