Sixteen months ago a new manager for my group was hired. I was an employee of good standing before she was hired. I went for the position even though I knew I didn't have enough experience. Her manager (the VP) told her I went for it. Immediately, she began to unravel my ties to members in the company saying that the people that used to deal with ME now have to deal with HER. (Emphasized here because of the voice inflection she used when telling me this.) I have been give such little gifts as Prickly Pear tea from a trip, and this past xmas, OBEY had cream and nail kit. Others received chocolates or little cute token gifts. She is jealous of the experience I have and has told me how frustrated she is that she doesn't know what I know. Because I was able to run the dept. without mgr. in the midst of massive change in the company before she was hired, and because others trust my judgement on how I do my job, she has taken to have others both within and outside of my dept., who want in with a manger, make my job infinitely more difficult. People she promoted and hired have taken to harrassing behavior and are, at her behest trying to drive me over the edge. Comments that were made over the phone by a new coworker were repeated verbatim in my review. She was talking about my review to a coworker?? I am unable to sleep and it is affecting my health. I enjoy my job most of the time, but the atmosphere there because of her and the others is unbearable. I went to HR after my first negative review, where she only knew me for 2 months. Just had my second review where the places I should've received highest marks, because of a personal issue with her, I received the lowest. I was fine that she got the job, I wasn't ready for it. I merely wanted to show that I wanted advancement. Now I'm being forced out and defamed in the process. She loses jobs that others send in to be done by the group and I get blamed for it, she has lied and I can prove it. Is there anything here that can be seen as an illegal practice?

The only health issues are between your ears. Are you all under 12 or adults?

If you don't like the way you're treated then leave. Otherwise, get thicker skin.

I think a more positive approach than insulting your mental capacity or your maturity would be to advise you to keep a log of everything that is going on. Document, document, document! Make sure it is clear and factual. If you have already complained to HR, make sure that is in writing, and if not, do it again, again in writing.
How long have you been at your company? How many allies do you have there? If you're well-liked, trusted and respected by any of your co-workers, surely that fact and that you've been at your company any amount of time longer than this other person must be assets to you. Use that to your advantage.
I cannot advise you as to a legal course of action as I'm not a lawyer. Howevery, if I were you, I'd run this by one, a real one, in person. Call around to find one that'll hear you out in an initial consultation for free. They should at least be able to tell you if your case has any merit.

Dear Belize Breeze, yes, it does seem that I work with a bunch of 10 yr olds! And it's more than what's between my ears though, I can assure you! And my skin's pretty thick, I've been able to endure for many months now.

Thanks for the good advice Avenger. Been there over 15 yrs., new regimes are hard, but I've been through a few now. Howevery, it doesn't need to be this hard.

First I suggest you learn employment law and the definition of wrongful termination, sexual harassment and hostile workplace.

Then I suggest you learn what at-will employment means.

This poster has no legal grounds to sue anyone for anything. And keeping a journal and seeking the advice of a local attorney will only take time and money away from what should be done, look for a new job.
