The Jacuzzi Disappeared

We rent the home we live in from a management company. We have never had any dealings with the owner. As part of the lease we have had use of the jacuzzi in the back yard. We have decided that when our lease ends we are moving and have given the management company notice.

Last weekend the man who takes care of the jacuzzi, and is also a friend of the owner showed up on a sunday with people to look at the jacuzzi. He said the owner was trying to sell the jacuzzi. I was not happy that he just showed up with people at the home, I called the management company and told them what happened. They said they knew nothing about it and kind of blew me off. This weekend while we were out, my son stayed home, the jacuzzi guy came over. My son didn't answer the door as he thought he was at the property to do maintenance (it was about that time). My son went on with what he was doing and we arrived home about 10:30 that night.

We didn't go in the back yard until morning. The spa was gone. I didn't know what happened to it so I called the police, my son said he heard nothing and he didn't see them remove the jacuzzi. I called the management company, they didn't call me back. I called them today, they said they didn't know what happened nor did the owner notify them of this. Since the jacuzzi is a part of my rent on this property, did the owner violate the lease terms?

What does the lease say?

you say "Since the jacuzzi is a part of my rent on this property", does that mean that it is specifically mentioned in the lease? What does the lease say about it?

Tell the management company that since the property is less useful now, you expect that your rent will be going down. They probably won't do anything, but its worth a shot. I wouldn't expect a big reduction anyway, since it is only a recreational item and not the main dwelling.

Arizona Community and/or pool addendum which expires 04/01/05. Which maintains that there is a spa, pool or any other means of in ground or above ground pool or spa.

Telling the "management company that since the property is less useful now, you expect that your rent will be going down" is useless considering that the OP said, "We have decided that when our lease ends we are moving and have given the management company notice."

The tenants ONLY concern at this point is to make management aware that the spa's disappearance was not due to their actions.... and to try to prevent that item from being deducted/charged to them. A good start to that is the police report. I would follow that up with a very nice letter to the landlord explaining the circumstances and the likely suspect.... and include a copy of the police report.

**A: I disagree. If I was the tenant, I would have a loss of an amenity therefore have a right to ask for a reduction in rent.
