This landlord has got to be insane

I have been renting for about a 10 months and I am on the section 8 program. Well recently my landlord got a letter saying that I had been paying too much rent and that she needed to refund all the money that I have overpaid immediatly. I was so used to paying this amount that I continued to pay her this for a couple of months and then when I realized that she hadn't complied with the notice I didn't give her my portion and pointed out to her that I have a credit from paying too much rent. She refuses to give me back what is due to me and keeps harasing me saying she wants her money. I don't know if she can do this. She gave me a three day notice but I dont think it is fair for me to pay her more money and she owes me. I am a single parent with two kids, survivor of domestic violence and I dont know what to do. Someone Please Help!

How much is the total rent required as set forth in the lease?
How much does section 8 pay?
How much have you been paying?

It sounds like she owes the land lord rent? p LUS THE STATE FOR FRAUD.

Excuse me can you read? the person said the landlord got a letter saying she needed to refund to the tenant money. how in the hell can the tenant be in trouble sounds like the landlord could be in trouble. contact the housing authority and tell them what is going on. if you have a credit coming and landlord has been charging too much I am sure that the housing authority can and will rein in the crazy loon

where the hell did you get that idea? her post says the LL owes her the money, not the other way around. if anything, the LL was defrauding the tenant.

Its time to plan on looking for a new place , see Section 8 will deal with the LLs over charging and should it come to court all you will need to provide is a copy of the lease that section 8 has on file and a copy of the payment history from them to the LL . The LL might refuse to renew the lease now and if so you need to prepare to find a new place , EVEN though side payments are barred from tenant to the LL it is your LL who will get in more trouble for it than you . Contact section 8 again and inform them that the LL has sent you notice about this . Should this go to court the court will see with your proofs that your contracted rent payment ( your portion and portion vended to LL) has exceeded the contract and likely award a refund . Your LL has risked being barred from section 8 program and may even see them start abatement against her/him to recover the overpayment . Since your in the 10th month now has s8 come out to do a annual re inspect ? if so has the LL began any repairs they ordered ? that will be a big hint as to how stubborn the LL is going to get , see if the LL refused to make repairs that might clue you in to start looking for another place because at some point s8 will start to hold back money from the LL as incentive to force the repairs they mandate . Your case worker should be able to assist you with payment history print out to the LL for court and plan on having your reciepts handy and dont you dare miss court . if you miss court your SOL.

Depending on the amount of overpayment , you may have to take your LL to small claims Court .

Why on earth would you continue to pay over payments 2 months after the LL was instructed to refund the over payments ?

There is more to this than the OP states, when a renter is on section 8 the landlord receives one payment from sec8 the balance from renter.

The rent amount was all ready established before the tenant moved in if the landlord wants $1200 a month that is what he wants section 8 cannot turn around to landlord and state later they want cheaper rent the rents too high.

The landlord is not required to set his rents according to section 8.

And I also doubt a tenant made a mistake paying too much over what their personal share is, unless the tenant lied to section 8 then tried to point finger at landlord.

Who knows what is really going on here.

The whole story stinks hence no response from original OP.

If the Section 8 program sent the letter to the LL, then the LL has to follow what is demanded by Sect. 8 or be refused future or immediate tenants from Sect. 8. The only reason I can think of why they are demanding that they were paying to much is if they are in a rent controlled area. Either way, it's something sect.8 would have to go after the LL for and not the tenant.

I am somewhat familiar with Sec. 8 program .
The OP stated they overpaid the LL ? , yet Sec. 8 is the Agency Demanding refund .

I agree there is more to this story .

Why would the LL demand the same amount from the tenant , when the LL agreed to the stipulated amounts .

You know everyone is not sane and lilke I said this woman is not sane. One minute she agree's and the next minute she is talking crazy and saying that I owe here more that she owes me. I have asked her for rent receipts and she will not provide them. She has the tennants mail the rent to a PO box and if you want to talk to her leave a message on the voicemail. I am new to the section 8 program so I did not know that I was not supposed to do that. I only continued paying the same because repetition I was used to paying that I didn't think twice. So I am not stupid just in a stupid situation. :mad:

You may not be stupid... we don't know that yet.. Your LL may not be insane we don't know that yet..
but can you answer south's question's instead of going on and on about either your possible lack of intelligence or your landlords possilble lack
of sanity.... huh?
