Back in the spring (May 2005), an old landlord brought a civil suit against me regarding a lease.
It turned the papers over to an attorney and he filed our answer along with a counterclaim.
Landlord answered counterclaim regarding only 3 points on 8/25/2005. There were about 20 allegations in my counterclaim and my attorney says that if they don't answer them, then they admit. Anyway....
Now what?
My attorney says that the thing will probably "go away". He has spoken to the opposing counsel and no one seems eager to push this thing forward now that we have the counterclaim thing going. My attorney says that it will probably die if they don't "push to have it heard". I guess get it on the docket.
What is the time frame for a civil case to just "die" if neither side pushes to try it?
My understanding is that after 180 days the court issues some sort of request for the "status" to both sides? Is that 180 days from the date the suit was filed or the date the last "answer" was filed? Is 180 days correct?
I have researched this on my own because I am trying to keep my legal costs down and lord knows I don't want to keep my attorney on the phone any longer that absolutely necessary.
