Yes I did have a hearing yesterday. My x didn't respond to the summons. She also cut all contact with my son (no more e-mails). She called my lawyer before he left for the courthouse yesterday morning saying she wasn't going to be able to make it to the hearing. By the time myself and my lawyer arrived at the hearing she had called the clerk and told them she was in the military and could not get leave to come to the hearing and requested to postpone it. The clerk told her that her lawyer will have to talk to the judge because only an judge and lawyer can postpone the hearing here in MS. She told the clerk she didn't have the lawyer (it has been 62 days since she was served) so the clerk said she should talk to my lawyer but he wouldn't talk to her.
Anyway, my lawyer conferenced with the judge and he granted the change of jurisdiction to MS. He also gave me temporary sole custody with her having visitations to be supervised by me and she cannot take him out of this state.
I am very happy as a huge weight has been lifted off my shoulders. I still have the actual custody hearing to go to and will probably bother you guys with more questions, but I feel very good about this.
Sounds like excellent news! The fact is that she had 60 days to hire an attorney to be there on her behalf. She didn't have to show up, just her attorney, and the judge knows this. She didn't bother, and she didn't try on her own to get it continued in a legal manner. Too bad, so sad for her. Very good for you.
