What is the name of your state? Indiana! My wife was contacted by an attorney looking for my son who had not returned a call. His x-wife is wanting to have her name removed from the title of a vehicle. The attorney asked if she wanted to know information about why he was calling. My wife did say yes. He then proceeded to tell her that my son was delinquent on car payments.

This upset my wife and after thinking a moment about it, I thought that this cannot be legal for an attorney to give out this kind of information. He had no idea about our relationship with our son and even if he did, this just can't be right. We have nothing to do with the issue between our son and x-wife and quite frankly it is none of our business.

The attorney told me that he was speaking for his client and that their was nothing illegal about it. Although, he apoligized many times. With all the privacy acts and laws that we have today, I just can't think that he was right in doing what he did.

Depends. If the attorney was acting as a THIRD party debt collector, then what he did was wrong... and the violated person (your son) MAY have legal options. However, if he was simply acting as your ex-wifes attorney in trying to remove his name from the vehicle, nothing wrong.

Thanks for your response. Just so I am clear, it was legal and ethical for the attorney to tell my wife that my son was delinquent on a car payment. It seems if this is legal, an attorney could call anyone and tell them someone else is behind on payments.

He is acting on behalf of my sons x-wife in trying to get her name off the title.

then he has done nothing wrong, your son has no expectation or agreement regarding confidentiality with his ex wife's attorney.

Based solely on the information in your post, I see nothing illegal OR unethical in your sons x-wifes attorney telling your wife that. He is NOT acting as a third party debt collector and would not be prohibited from contacting you with that information.
