However that isn't the way that the law sees it. The law sees it as you don't have more children unless you can continue to support the prior children AND afford to have more children. Clearly something went massively wrong in this guys situation for it to go from 61.00 to 350.00 plus arrearages.
There is enough money involved here that he really needs to get himself an attorney in NY.

that is not true that the courts do not consider other children!!! i am married ,and my husband has a daughter from a previous marriage and he went back to court to get his child support modified. We have 3 children together and they lowered his child support. :rolleyes:

It sounds to me like the courts are saying you shouldn't be married. If they told me they wouldn't take my other kids into consideration, I'd say wait a minute lets postpone this hearing so I can get a divorce and file for child support real quick.

No, the court is saying that you should think about your current obligations before having more kids. Your mortgage lender isn't going to cut you slack on your house payment because you've had more kids, either.

Unfortunately they do not take other kids into account. First kids first! Also you have to keep in mind your other kids are not the ex's responsibility. There are guildlines, but do your home work(like you are) and find your in and outs. Good luck!
