the officer said i ran through a "steady red" light but i maintain that it was yellow the last i could see it (it was definitely yellow when i crossed into the intersection). my buddy driving in a car directly behind me also swares that the light was yellow while i was under it. in fact he almost tried to make it through the intersection himself to keep our group together (we were travelling in a caravan).

the cop was sitting roughly 2-3 blocks ahead on the opposite of the road. it was 10pm at night and there was a steady rain. i think my buddy had a better view of the light that the cop did but it's his word against ours. it was closed to the end of last month so i'm thinking he was up against a quota but i dont' know. can anyone tell me if i have a case here or if they've seen cases similar to mine and how they've turned out?

i've searched around for the ohio law on intersections and traffic signals and can't find the law regarding yellow lights and what is considering disregarding a red light. so if anyone could find that as well it would be of great help to me.

i've already appeared in the town's "mayor's court" and pleaded "not guilty"; my arraignment is next wed. nov. 17th. in the wayne county muncipal court. any advice given from anyone out there would be greatly appreciated. thanks!

I've never gotten a ticket like this but I know once when I was in court another man did and the judge said that that defense was the worst defense he had ever heard because yellow doesn't mean to go through the light. If it were me I would still fight it and when you get your court date, if the cop shows up try to bargain something out with the prosecutor...I know everyone says if you plead not guilty they won't bargain but on every occasion I have fought a ticket and the cop showed up I was able to get the charge reduced to a non moving through pre trial bargaining. And if they aren't willing to bargain keep your defense and hope you get a nice judge.....although I have never seen one.
