Then, I might not even get what I paid for it, no? and I have to go back to Texas at some point to pack, so no matter what, I have the Texas move to make. And if I don't clean out my classroom before they find out I am moving, the other teachers will pillage my room and take my personal/professional things. I know that sounds crappy, but I know it will happen.

a) You can sell a house through an agent without having to be in the state. My parents did this when they moved out of the country for 11 years. And with the housing market the way it is, feel lucky that it gets sold at all. You can put it up for auction with a minimum threshold so you don't lose money on the sale. b) I think losing some "personal/professional" items in a classroom FAR outweighs potentially having the case move back to TX instead of OH. Think about it: would you want to have to wait until Dec. 13th and HOPE Dad doesn't file something in TX before then just over some teaching materials & personal items? Is there not a co-worker who would be willing to go to your classroom on your behalf and box up the items that are important to you?

The house and your teaching stuff are just material possessions. In the big picture I think being able to stay put in OH would be better in the long run then going back to TX for 6 weeks and live with the risks. Just my 2 cents...

Wow. That is actually a very good point. Seriously.

What kind of surgery does your child need? I am of the opinion that you absolutely should not go back to TX for any more time than is needed to pack up the rest of your furniture etc and get it moved to OH, but your child's medical needs could possibly dictate that you need to fullfill your contract and retain your medical benefits.

However, if you absolutely have to do that, then you need to understand that dad could take legal action and force you to remain in TX.

I'm sure we could debate all day about the expense of jobs, continuing education, college classes, and the salary earned per job. Lawyers seem to earn a lot more money than teachers - but we could debate hours worked, vacations, etc. I was just saying that in my situation, it was a lot of money.

Emphasis on the word seem. NOt all lawyers earn a lot of money.

If I quit my job, I can go on COBRA - then I am guaranteed insurance when I get a new job due to HIPPA. But I would be paying $700 per month for that.

You need to LOOK INTO MEDICAID!

If I go on Medicaid, from what I understand, then I would not be eligible for private health insurance from the new school district that I work for due to my diabetes, which is a pre existing condition. I live in fear of the pre existing condition. Because of the Medicaid, I would be denied.
Medicaid is insurance. You would NOT be denied if you are continuously covered. YOU NEED to contact the medicaid office and talk to them. Department of Job and Family Services.

Going back to pack is a lot better than going back to work and live.

I guess that is what I have to deal with. So, I couldn't petition for custody/visitation before that? Dad has wanted this to be informal from the very beginning. He doesn't want to go to court. He wants to work things out between us.

Nope. You can't petition before you have been a resident for six months. If you go back to finish out the school year you are going to run into jurisdiction issues.

Actually, that is the opposite of where I was going with that. I will be in Texas six weeks. I'm offering him six weeks with the baby. He's choosing to go fishing, hunting, and vacationing. He knew when we were going to be there, and he still made plans. I chose a man who's priority is fun, not family. and I chose a man who's job OWNS HIS SOUL. that's something that makes me very sad, not very jealous. I feel very stupid for not knowing what I was getting into.

Live and learn but do what is best for your child.

That's probably the most true statement I've ever heard. I know I'm adding a lot of personal details to the child custody issue, but there is so much that is affected here. I'm so glad to have you all as a springboard, helping me brainstorm, and helping me know what some of my options are.

Yeah well I was harsh with you after rereading it several hours later but quite frankly you need to look at the big picture. And you need to realize ALL of your options.

She needs to do long term thinking.

I remember you from the past. I also remember that you didn't listen until you were almost at "crunch" time.

You need to be consulting with an attorney.

Gee, I think that is WAY HARSH.

Hum has always listened when she has gotten actual advice instead of drivel crap.

So, is this actual advice?:rolleyes::rolleyes: ooh, no, it's that other stuff.

She needs to do long term thinking.

Absolutely right!

I am racking my brain to make this trip to Texas short enough to be a "visit" but long enough to maintain my medical benefits. And to pack the house.

I don't really want to discuss my baby's birth defect, but it is to his private region. He needs a pediatric urologist to fix it, and it will require a hospital stay and catheter. We have already seen the surgeon up here (baby's dad went also, because we saw the doc right after the birth while dad was still up here) and dad knows the surgery wouldn't be possible where we lived on the Mexican border. My mom is a pediatric nurse, and I absolutely want her to be there to supervise the surgery and help in his recovery. She doesn't have any more FMLA left after taking care of me while I was unable to see and having the blood sugar problems. So the surgery needs to be done here. There is no question of that to dad or myself. He absolutely agrees on that.

I'm calling about medicaid tomorrow, along with applying to every school district I can find. I'm also looking at non teaching jobs, at least temporarily.

I'm taking your advice Ohiogal, and making this a "visit" and not a stay so that I don't run into that issue. I'm going to get what I can out of my classroom, pack the house - and get back to Ohio. I'll make some excuse. I may not need to make an excuse if either baby or I get sick while down there.

You know - someone PM'd me and suggested I leave the baby in Ohio while I go to pack. Is that even an option? I am really not inclined to let him out of my sight, but would that in any way change anything? I know someone is going to call me names for even suggesting it, but its just a question???

Wrong. Texas is one of only SIX states in the nation that is not reciprocal. Texas has the lowest teacher standards and easiest teacher test because of the issues with not being able to get teachers. Texas does not take the Praxis, which is what the other 44 states, including Ohio, require. I cannot teach in Ohio until I am certified by Ohio.

Thats what the Board of Ed told me. Do you know something I don't know?

Sorry about that. Indiana University gave me a list of states where I could teach, since I'm licensed in IN, when I finished grad school. Both TX and OH are on it. I just looked at the OH DOE, and see that they won't accept your TX license under the Compact.

So, how far are you from the IN state line?

Newspaper article today (Monday) stated that Columbus has opened up medicaid:

"Ohio officials are taking applications for state-subsidized health insurance for children with special medical needs. The 410.1 million program offers help for families with incomes above 300 percent of the federal poverty level -- about $63600 a year for a family of four. The Children's Buy-In Program is open to families who meet one of the following requirements: They are unable to obtain insurance because of a pre-existing condition, they lost coverage due to a benefit limitation, they would pay twice as much for insurnace outside the state program or the child is in the Ohio Department of Health's program for medically disabled children. Coverage will begin in June with premiums ranging from about $250 to $500 a month. Go to jfs.ohio.gov/ohp/cbi for applications. Children in families with incomes less than 200 percent of the poverty level are covered by Medicaid. State officials are trying to figure out how to cover children in famliaries in between 200 percent and 300 percent of poverty levels after federal officials last year rejected a request to expand Medicaid."

Hum's baby should qualify.

It could change things if there is a guardianship paper set up for your parents with the baby. And the baby's legal residence is Ohio.
