Hello all,
I sent my truck(89 Mazda B2600 w/ camper shell) to a mechanic who has his own business to replace the engine in my truck in Dec 05. It took approximately 1 month for him to find the engine for my truck (brand new) and have it shipped to his house. I still have not gotten the truck back. I have been in touch with him at least twice a month since he has had it so that I could know the status of the work. Since March 06, each time I talked with him he told me that it would only be a couple more days. Now 9 months later, still no truck. So far I have paid him $2300 ( I have proof of this) toward his total bill of $2740 for the brand new engine, an engine kit, labor to the machine shop, and his labor.
I just went there and took pictures of the truck and he was not there. The truck is a complete mess, including a sliced flat tire. It was in very good condition other than the engine when he got it from me. The "brand new engine" doesn't look brand new at all anymore. It looks rusted from the outside to the inside. I have no receipts from him to show for buying the new engine or for the machine shop. I use this truck for work ( I have my own business) and because I did not get my truck back in what I would call a "reasonable amount of time", I had to rent a Uhaul van for work. When I stll didn't get the truck back, I ended up having to buy a work van and have repairs done so that it would run. After seeing the truck today, I really do not think that I want it anymore.
My question is can I sue him for the money I have already paid him PLUS the money I had to pay for the work van and the Uhaul rental? I would appreciate any and all help with this matter. Thanks in advance!!!
