Hello FAF Members!
Just discovered this wonderful board and thought I'd throw my problem out there for you folks.
During the last week of my high school career I recieved a detention that was completely unjustified. I went to work after school everyday so I didn't go to my detention. I was, however, arriving at 6:30am for the last two weeks of high school to catch up in a TV class of mine. They offered to let me take the detention at 6:30am on one of my last days and I said, "as long as I can serve it in the TV room so I can work during the detention". They refused. I recieved a truancy ticket in the mail for 65$. The arraignment is July 23rd.
Some factors to take into consideration:
This would have been only my second detention in my entire high school career.
The administration made an exception for me just so that I couldn't work on my final exam during my detention.
I was 18 years old well before all of this happened.
Now a friend of mine said he previoulsy obtained a truancy ticket as well and that he went to court and explained to the judge that because he was 18, that the school couldn't force him to go to a detention, and the ticket was dropped.
I was curious what actions would any of you suggest?
I have read a bit about Motions to Dismiss, is there anyone here familiar with them enough to know if I should bother preparing one? Would the circumstances and my previous record be enough to get it dropped without having to appear in the first place?
Thanks in advance for any contributions.
Nick
