Trying to Claim Surplus Funds post Old Foreclosure

What is the name of your state (only U.S. law)? North Carolina

I spent more than a year trying to locate information in reference to surplus funds due to us from Foreclosure Sale in 2003. I am now in possession of a copy of the Final Report and Account of Foreclosure Sale. This indicates surplus funds paid to the Clerk of Superior Court, Mecklenburg County. Also have copy of Payment Authorization with our names listed as Payees. Under Notes it states Order Needed to pay out. And here I hit the Brick Wall. I was told it would be 120.00 to File. When I politely asked File what exactly, the response was I would need a Lawyer. No further information was forthcoming.

I am a disabled brain tumor survivor. I have however, successfully faced situations with abusive ex husband, IRS, NCDOR, SSD, and more Initials. If I know what I need to file, I am sure I can handle this without attorneys, for whom I have respect but can ill afford. If anyone can offer any assistance in this matter I would greatly appreciate same. Thank you for your Time.

Otherwise, why do you think you would get the money if the check was made out to both parties? If it has not escheated to the state (See the link.), I suspect you need an attorney to get the funds.

Thank you for swift response. I do not think the money should go only only to me. Payees are my husband and me. I am just the one doing legwork, as he did not think anything would be there. I have checked the escheat list again; thank you for the link.

Thank you Both for your Time. Checked again. Not listed. I understand it is still with the CSC office. Which is why I was told I need to file a motion for an Order to pay out. Also a letter of Petition which I have already drafted. Still no closer to knowledge of what else I am supposed to File. , only that it will be 120.00 to do so. Search Continues.
