Hi, I know this question has been asked before but I keep on getting different answers, somebody please help me figure this out. When I was 18, two years ago, I was arrest/charged with grand larceny and criminal mischief, I took a plea for misdemeanor trespassing to agricultural land and completed 10 months probation. Since my arrest I got a full time job (fast food), made restitution and am a full time college student now. I have a 3.8gpa and intend to become a pharmacist someday.

Sorry about the long post but here’s my question can I or can I not get this misdemeanor expunged? I got accepted into pharmacy school but The Colorado Board of Pharmacy will not give me a license with a record reflecting moral turpitude so I need to know if I need to change my major. I know I messed up in the past but I have done everything to make things right, can somebody please shed some light on this for me.? I consulted a few attorneys in my area and got varying answers.

Check with the governor's office or attorney general to see how you can get a pardon or an expungement.

A pardon is supposed to relieve you of civil disabilities of a crime but the crime is still on your record.

Expungements are generally for unlawful convictions only.

Also, background check companies, if they have already picked up this conviction, will not delete the record even if it is pardoned or expunged.

Check with the pharmacy board to see for sure if this conviction will keep you from practicing. I doubt that misdemeanor trespass is classified as a crime involving moral turpitude. That usually means something like rape or stealing.

When i contacted the board of pharmacy, i was unable to talk to anyone with authority, I talked to a few receptionists and they just transferred me around without giving me a conclusive answer.
From what i was able to gather, it would be almost impossible for me to get a license with a misdemeanor involving a plea bargain(they do a background check) The only way to obtain a license with a "record" would be to appear before a board hearing and hope they give it to me. They also said that even if i do manage to get a license, It would be even harder to get a Job since they can bypass the 7 year limit for criminal records. It’s already been more than two years since my arrest and i intend Start pharmacy school next fall. It sucks i spent all this time going to school for an occupation may not be able to have.

Can anybody refer me to a competent attorney who specializes in expungements in CO, Is it even possible? It seems it’s my only viable option.

Yes, you can have the misdemeanor expunged. Also, I don't believe trespass is a crime of moral turpitude. Lawyers who cheat and steal are admitted into the bar, and even go on to become judges.

Also -- stick with your career choice. Going to pharmacy school will be one of the best decisions you've ever made in your young and naive life. There is a growing shortage of pharmacists, and by the time you get out you'll be making an excellent living.
