trying to violate me

What is the name of your state? Indiana. I was working double shifts at work and one night I got home and found paint bags and a can of paint in my house. I called and reported it to the police and told them I was not currently living there but I go there and get my mail every day and check on my house. I told them there was a problem with kids in the neighborhood huffing paint and they had arrested them many times before in the neighborhood... I told them I would keep the stuff for them and they could take it for evidense , or get prints to find out who was getting into my home. I asked them to keep an eye out for any kids around my house and nobody should be there. The next night right when I got off work, they cops pulled up, took they dried paint bags from the night before and said they were going to try to get a warrent for me. I was dirty from work. (dock worker). Once they turned in the report, they decided not to charge me..... anyway. the next week, I was arrested for a probation violation for the report that my PO read from the police report.... I was never charged. I lost my job and spent 28 days in jail because they wouldnt set bail for the violation... How can they do this? I was the one who asked them to come get the stuff and was trying to put a stop to this neighborhood problem.

Anytime a call is made to the police it is logged. You should be able to give your po the time and date of the call that you made and it should prove your story. Have your attorney check into this or you can do it yourself. Good luck.

I showed the probation officer the report I made... He sent me to jail anyway for 28 days.... The cops know I reported this and know that I wouldn't do it. (that's why they never arrested me for it. ) The question is How can probation violate me and send me to jail for 28 days without bail when I never did it, wouldn't do it, and wasn't ever charged with doing it? THe probation officer does NOT like me a bit and has tried everything to violate me. Is there anything I can do about this.

Yes be a very very good boy until probabtion is over with.

That will prove if you are man enough to live on the outside.

hmmmmm did you report to you PO your new address before you told them you were not living in that house?

if not you violated your parole.

Tascott- It's a little difficult to determine your issue since you did not explain what your probation restrictions are. Normally, storing paint containers does not amount to a probation violation. Since you were apprehended for a probation violation, I can only assume that you have been ordered not to possess materials which contain mood-altering chemicals such as those found in paint containers.

Unfortunately for you, you already did your time for this. So your question, "How can they do this?" is obviously a little late. At your probation hearing, you were given the opportunity to be represented by an attorney and dispute the violation with which you were charged. Either you did not do this, or you lost.

At this point, all you can do is ensure that any further suspended jail time that is hanging over your head isn't executed. If you have concerns regarding further paint cans appearing on your property, you may want to contact your PO and discuss this.

I would like to thank you for your response from quite some time ago..... My original charge was owi in 99. I would also like to let all the people that have replied to my posts know that The Judge "MIA" Roby in Indiana is now being questioned for all her wrong doings, lost and illegal funds, and other charges are pending.. As for all the Elwood Probation officers, they have left their positions as well and are also being investigated by the state for lost and or illegal collections, arrests, and etc....
