The ticket was misplaced, before sending my first letter over a month ago, I reached out a number of times requesting a copy, or asking if I could pull it up online. They responded no.


For the sake of moving forward, lets assume I did send a ticket and they haven't answered, what would be the correct next step?

A request for a supporting deposition must be made with 30 days of the ticket return date.

The supporting deposition must be provided within 30 days of the time the request is received by the court or at least 5 days prior to trial, whichever is earlier. This is all outlined in NYS Criminal Procedure Law 100.25.

Failure to provide that deposition in a timely fashion may be grounds for dismissal. A motion to dismiss must be made in writing to the court sometime prior to the trial/appearance date.

The dismissal doesn't seem to be automatic and a judge may chose to deny your motion. I've never seen that happen though.

You must keep copies of all correspondence along with receipts for the certified mail. This will do nothing but help you in your quest.
