My friend went out of his status, and a friend did him a favor, and married him to be legal in the country. HE NEVER FILED PAPER WORK FOR CITIZENSHIP. He and his wife are like best friends, and nothing more, but they are living together.
My friend ended up falling in love with a girl of his age, and now he is planning to marry her, considering the fact that he has never filed for the paper work, thereofre INS will never find out. Also he loves this new girl, and his present wife understands. She is moving away anyways. Please advice on what to do? Would INS find out about his both marriages? Or should he get annulment? Divorce would look bad on his part, if he applies with his wife to be for citizen ship.. Thank you.

Being married did not make him legal. That only comes when you file I485 to Adjust your status. I do not know if he can get it annulled as you would have to give very detailed reasons.. which mean he would have to lie under oath since he can not give the real reasons.

Also, if he does divorce and remarry, he will have to show all papers when he then files the I485 or the INS will find out.. somehow they will.. and if they do, he is outta here. Sometimes, if an application is so bad and filled with lies, they will lock him up then and there.. and then arrange to deport him within the next few days. The INS does not always follow or allow for due process.

Also, there is a lot to do before he should even think about citizenship.. You have to file to adjust status.. wait 2 years for an interview (depending on where you are). Then you have a 2 year conditional residency status. THEN you get your 10 year green card. Generally.. you have to be legal in the US for at least 5 years before you can even apply.

My advise is to see an immigration attorney.. one bad move on his part could see him thrown out and barred for 3,5 or 10 years.
