Hello. i was turned down for a mortgage from my bank. my bank put me in contact with a broker, i gave broker copy of my current credit report, told him not to pull new report, as i could not afford to lose any more fico points. brokers assistant contacted me with rates, i declined and said i would go back to my bank in a month after i paid down some debt. pulled a fresh credit report and found that the broker pulled three hard inquiries on all three agencies. he had no verbal or written authorization from me, know when i went to re-fi at my bank, my fico was 10 points lower then what i need to qualify for the loan package i needed. when i spoke with my banker, i asked her if she issued broker my authorization release, she said, no way. called the brokers assistant, asked why she did this, she said she did not know she was'nt suppose to. asked her to contact agencies to have them removed, month later, she has done nothing. under fcra i should be able to sue them. is it 1,000 for each agency report, or 1,000 for each hard inquiry. either 3,000 or 9,000. plus i will need to wait at least another month for these inquiries not to cost me any fico points, and i have already lost at least 1 percent interest because of rate increases. how should i proceed with this, what should i sue for. wisconsin small claims is 5,000 . could i go civil for more? should just stick with the minimum. thanks.
