Okay, if you have been initially denied and have appealed the decision and now have a hearing...I repeat, keep making the weekly certifications between now and then.

You will be, if this is what this is, an appeals hearing, either on the telephone or in person before an appeals referee/judge/officer of the agency. Your employer will also be there. You will both be sworn in. You will be given the opportunity to present your appeal. What I would do is say very clearly and succinctly that you did not quit the job. That you were told at the beginning of the work period that you would work from xx to xx dates. You knew, the whole time you were working that the job was scheduled to end on xxxx date.

You worked up to that date, and then were to leave. Did they call you in, give you ANY KIND of separation letters? Did they thank you for your service, talk to you, have a party for you, anything? You didn't just abruptly stop going in to work without ever being mentioned that Friday would be your last day, did you? Surely somebody said something. Weren't you still working for them when you asked if you could continue to work for them? Bring up exactly what you were told the last day of your job.

You do not need to go all "Lincoln" and make a brilliant speech or argument resolving that you were laid off, you just need to state the facts.
And do not bring up one word about your school situation or your availability for work right now. That is NOT what is being adjudicated in this decision, not the reason your claim was stopped. All you want to deal with is whether you were laid off or quit your job. State very succinctly that you did not quit your job. You even asked them if you could continue and they told you no on such and such date. The one you were actually laid off on, of course.

If they say you quit to go back to school, emphasize that you did not do this. You did not quit the job. (Are you getting on to the idea that you cannot say this phrase too many times while speaking?) You were laid off, after asking them if you could continue to work longer.

Go on with how you filed for benefits, stating what you understood to be true that your job was over and you were laid off due to lack of work. Say, without discussing your school situation at all, how you were contacted by them on whatever date their recruiter called to offer you the new job next summer. Say that you refused the job, because you were not sure of what would be going on or whether you would actually have another job you were very interested in by that time. But stress that this job offer was NOT for any time until next summer. Don't point out to them that this should indicate you left under good circumstances. You did anyway, you don't have to "prove" it or argue about it. You did not quit your job.

Then of course how you were very surprised to hear that you are being denied because they say you quit. You did not quit. That's all you need to say. If they had work available for you, you'd be working for them right now. They laid you off due to lack of work.

As I said, the school issue and your availability is another separate issue which is not being adjudicated at this time. Do not bring it in if possible, and if it comes up, emphasize that you are going to school on line, that you are fully able and available for work and that if you had been offered a job with your former employer for the present you'd be working for them right now. Once more, you did not quit this job.
