What is the name of your state?CA

Let me start out by saying that I currently had a lapse in coverage due to financial burdens and loss of job. During this short period of time I was rear ended on th freeway during heavy traffic buy a truck. The driver had insurance but at the time I did not. The accident was his fault and he did admit it. I took all of his information....will his insurance company still have to pay for my repairs even though I did not have insurance or do I have to pay for them on my own? Help would be appreciated.

The person at fault is liable for the damages.

My response:

You're entitled to your vehicle repairs, your medical bills, and loss of earnings. You ARE NOT entitled to "pain and suffering". Please remind yourself about Proposition 213. You can Google "Proposition 213" for all the particulars.

get ready for the bad news. once you make the claim with the other carrier, the accident will be reported to the DMV. The DMV will suspend your license for 6 months due to your lack of insurance. you will then need to provide proof of insurance before you can reinstate your license.

Sick and tired of uninsured motorist

If they're already driving uninsured, what does it matter if the DMV suspends their license? We need tougher laws against people that drive uninsured!

How about execution at the scene of the accident? Once the officer determines there is no insurance, BOOM!, 9mm to the head. Makes an example for all of the other people who stop to witness the accident.

I think so too, even though it's hurt my practice because I've had to turn away innumerable potential clients. Without the ability to obtain General Damages, the potential client is on their own. But, the benefit to society as a whole far outweighs whether or not I'm able to sign up a new client.

Back in 1997, when it was on the Ballot, Proposition 213 won handily. It was a no-brainer, and it was a long time in coming.

All you need to do is write a letter to your State Legislators and demand that they emulate Proposition 213 in your State.
