What is the name of your state? Washington State

Years ago I had a blood transfusion when I lost my foot. Since then, I have to deal with a prosthetic leg and a weaken immune system (I get sick easily). Most people don't even know of my disability, as I try not to let it interfere with my job or the things I enjoy doing.
I recently gained 15 lbs. which affects how my prosthetic fits and also broke the foot portion. Combined that with partially collapsed lung, separated ribs and the typical flu's and colds I catch, I've missed a lot of work in the last 7 months. I've had doctor's notes to verify my absences. After being released to work this last time, I wasn't allowed to clock in and was suspended for attendance pending investigation. Is this a valid suspension/termination?
The Union told me to become versed in the Disabilities Act. I was wondering if there are any court cases similar to my situation that I can present in my defense when I have Mediation on the 23.

In any event, the two pertinent laws you want to take a look at are the Family and Medical Leave Act, which entitles an employee to take up to 12 weeks of leave time over the course of a calendar year or 12-month period provided various criteria are met, and the Americans with Disabilities Act, which requires employers to consider making "reasonable accommodations" (and implement then when feasible) that would allow a disabled individual to perform the "essential functions" of a job. The ADA does not require an employer to extend unlimited absence time to an employee however, regardless of how legitimate the reason is.

You don't want to be reviewing court cases - you'll get lost in the detail. All you need to do is type in "ADA" and then "FMLA" on any search engine and you'll get all the info you need to see if either of these apply and what the requirements are.

Becoming Versed

Thanks Beth3! Never thought I would be put in this position to research ADA and didn't know the FMLA would apply. Thanks for your advise! I'm proud of the fact that people including Doctors don't realize I have a prosthetic and am disappointed to be in this position.
