I'd agree in principle, and yes, it is worth the try. However, it has been my experience with a number of different insurers over the years, that the agent is unable (or actually unwilling) to give out any specific amount, for fear that underwriting will somehow come up with a different result if/when the time comes for a policy review.


And that's what happened. She called the insurance and they had no idead about it. They said that VC was not on their system.
When she first called, they said that any violation would increase the premium in $1.5k to $2k, which I think it's a total BS response. It should depend on the violation.

So the insurance could still go up with a 0 point violation?

By the way, I would still appreciate if one could tell me if I can request discovery for this kind of violation. If it applies, I might go the route of request discovery and if I don't receive it, make a motion for dismissal on the TBDW.

That's the thing. I don't know what would apply since it's not a speeding ticket.
If it was speeding ticket I would ask radar, pacing, calibration data, etc....
Could I request the information on what sign was it that she didn't obey?

I am not sure, that's why I am trying gather some help here.

Unless you are an attorney, you cannot represent somebody else.
 
I never said I would represent anybody. She is my GF and I am helping her with the ticket since I have won tickets in the past for myself.
 
Please stop trolling. I am trying to get some help here. My GF is our of a job for 1 year and I am trying to help her avoid the $200+ fine and/or any possible increases in her premium.

In PA, when a cop gives you a "failure to obey signs" ticket instead of a speeding ticket, they are doing you a FAVOR by replacing a point-violation with a no-point violation. I suspect it's the same in CA.

That's my understanding for CA too. But the insurance co. can't give a straight answer as to whether or not the premium would go up. So I am trying to get information on ways I can still help fight this ticket.

They're not the same, but they are related.

Ask for a full copy of the policy to be sent to you. Read the whole thing. It should include the schedule of rate increases based on accidents and infractions. If a violation with no license points increases your rate at all, I would expect it to be 5% or less. But all the surcharges have to be spelled out in the policy. You may just have to read through a lot of insurance jargon to find it.

You could ask for any documents related to the charge and anything they may wish to introduce at trial. See what reply you get, if any.
