My ex and I have been divorced for five years. I have been remarried now for 3 years. I have had full custody of my 6 and 7 year olds for 2 years. I have two questions.

According to my custody agreement, my children are not to be in the presence of their 11 year old half sister unless there is another adult supervisor other than their mother. But, when they went to visit her this past week, the only people present were the kids and mom. And my son came back with a black bruise on his back from the half sister. He also told me that the half sister hit him several times and when he told his mom she said that he should not hit girls. So the 11 year old continued to hit my son. I am VERY angry about this (she also lets my 6 year old daughter hit him and does nothing). She has never paid her court ordered CS, yet I continue to let the kids visit her, what can I do legally about this issue? What would happen to me if I refused to let them go back?

2. I have a new daughter who is 3 weeks old. My ex told my kids to throw my baby on the floor! Is there anything that I can do legally about this? While I do believe that my kids are old enough to know not to do this, I know that they are also easily influenced by their mother since she is an adult who should be guiding them in the right direction.

Start documenting these types of comments.

Also, if they were alone with the half sister and the mom without another adult and the order says not, she's in violation of a court order.

Also take her butt back to court for non-payment of the support.

Take pictures of any injuries that the children return with and document the kids statements as to how these injuries occured.

This can be a step in the right direction for further limiting her visitation rights.

Child abuse, even if she's not the one hitting. Take her to court for modification of visitation on these grounds. Be sure to take pictures of bruises and other marks, and take the children to the police station immediately and file a police report as well as soon as anything happens.

You can file a show cause for contempt of court motion against her for the non-payment.

What would happen to me if I refused to let them go back?

You could, at the maximum, go to jail for contempt of court. At a minimum, you'd be in court explaining why you are violating a valid court order.

No. Not unless they actually do it and you have proof the mother initiated it or, you see it yourself.
