unwanted dog issue

What is the name of your state? new york, my sister resides in my home. I am the home owner , am in the process of evicting her but have a problem with her dog , She has a large Shepherd dog and my homeowners insurance refuses to cover him due to biting issues with the breed . I want the dog gone now , do i have recourse to have the dog removed ? Do i need legal assistance to do it ? She allows the dog to roam free so i am in jeapordy of a law suit if it harms someone . How do i remove this dog from my home ?

**A: Just remove it from your property. Then move the dog out.

you should be able to call the humane society or ASPCA, or something on that order. tell them about the insurance problem and that the "tenant" will not remove the pet from the property. you want it gone as to avoid prosecution if something happens since you are the property owner. if that doesn't work... have it removed by the "dog catcher". just make sure you have warned them about what you will do if it isn't removed on their own accord, (since you stand great chance of having your insurance dropped if stays their).

How many days does she have left before she has to vacate since you are evicting her? The reason I inquire is that if she will be vacating soon, the dog will also.

How many days did the insurance company give you for the dog to be gone...doggone...ok sorry...

The pet and the owner are still occupants, I assume. I would be careful removing the dog without her permission, unless you make arrangements for the dog to be secured until she picks it up and takes it to her new home.

If she allows the dog to roam and there is a leash law or city ordinance against this, then you could call the animal control officer to pick the animal up, while it is out roaming.

dog trouble

yes brother owns home , i'm writing this for his information as he is computer illiterate .. we need advice on this issue as the holidays are coming and sister and dog are still here and look like they will remain forever ( the eviction is taking forever ) our homeowners insurance wants us to sign a form releasing them from responsibility should the dog bite, leaving my brother legally liable in a suit .i did not suck you in and am asking for help because someone told me this was a good place to look . We do not want to just remove the dog as she will sue if she has a cause . This is why i am asking advice . not to blow smoke ..

it has become more pressing since last month because the sister in question is refusing to leave , and is claiming squatters rights , my brother an i are desperate , if shes not gone soon , i'm afraid i might be writing this next from prison asking for advice on how to reduce my charge from murder 1 to manslaughter ,, living with her is like living in " hell " and now we have insurance people refusing to insure us due to her dog

i hope the dog doesnt eat some poisoned meat that some malicious person threw in the yard. That would be a real shame.

Are you implying caninicide, or sistercide?

Whoever owns the house (I only assume it is not an apartment) should have the legal right to live in their own home without unwanted guests. If you cannot afford to hire an attorney to make this happen, go to legal aid.

BTW, is your sister a redhead?

Does anyone know how the term "redneck" came about?

When coal miners in Southern WV and Eastern KY would go on a "wildcat" strike because of working conditions, they'd tie a red kerchief around the neck. Just some useless trivia rattling around in my brain.:D
