What is the name of your state? MO

It has been 13 days since I filed my motion - pro se. I paid all of the filing fees and the service fees, but they still have not served my ex.

They seem to be really dragging their feet on this one. Reading up one it - he can be served by the sheriff or member of the court - OR by an uninterested party. Which I assume to be a private process server.

My question - Can I have a friend - totally uninterested party, no relation or anything - serve him the papers?

Hey Ambr, was just surfing and came across your recent troubles with the clerk's office- maybe that's why your service was back-burnered? Maybe if you contacted the neighboring county's clerk's office they could give you their opinion on process rules and regs.... hope things are going well with the kids; has the ex given you much grief since you got custody?

Thanks for the remarks in your earlier posts, I just filed my initial brief with the Appellate court a few weeks ago, so I'm waiting on my ex's (new) lawyer to file her reply and then we'll see if there is really any justice out there for divorced dads. The case law I'm banking on shows that the judge really went way out of bounds
in many of the decisions he made in slamming me, if he gets away with it at least I can look in the mirror and tell myself I did all I can....same thing I'll tell my kid when she grows up.

I'll be posting the results either way, wish me luck and same to you. JY

Okay, so my opinion of lawyers might be changing - just a little. There is a reason they go to school for sooooooooooo many years. This is a lot of stuff!!!!! (BUT I STILL FEEL THAT SOME LAWYERS GET BURNT OUT A LITTLE BIT AND THEY DON'T RECOGNIZE THE NEED FOR SOME WELL DESERVED VACATION TIME TO REJUVE THOSE BATTERIES AND KEEP THEIR PERSPECTIVES!!) No offense IAAL. haha

Anyways.....the kids have been doing pretty good. We are doing the counseling sessions, group and individual. The nightmares are just about gone. They have one every now and then. My daughter is able to sleep without a night light again. So, the little things are starting to feel like major wins. The last go around, I had a stipulation put into the custody papers that requires dad to participate in counseling sessions until released by the treating physician / counselor as a condition of his custody / visitation time. He attended two sessions and stated that they were a joke and that he saw no need for them. He hasn't been back. The kids were going to his house to visit on the weekends. The situation between dad and the stepmom hasn't gotten any better. The last few visits, the kids were talking about dad fighting and putting his fist through the wall. I guess you might call that progress, it was a wall and not a person. So I went back to child protective services and they helped me get a temporary order - I don't think he was suppose to help as much as he did, but I got to know the caseworker pretty good over the past few months. And now, I am working on a modification to get his visitation time "sort of" supervised. I want the kids to go to his parents house. They can stay with grandma and grandpa - where I know that they are taken care of. The bonus is that their dad "puts on" (for lack of better words) in front of others and doesn't argue and fight when he is around anyone else. Just in his home. So the kids get to visit with dad, but they don't have to put up with all the dramatics.
