Hello all, friend of mine got arrested with a dime bag of marijuana last night....Police officer took him to the station and took a picture of him...The process took about 15 minutes, they let him out with a UPM ticket...hes 19 yrs old and this is his first offense....I was just wondering what the penalty is going to be, I heard that its a fine if its your first time...But is he going to get Community service or Probaton???and also is he going to need a lawyer to be present in couurt???and also is there going to be any difference if he pleads guilty or not guilty??

Ya know, it's a wierd thing about people. When someone asks a question like this:

that a 5 yr. old should know the answer to, some people get the distinct impression that your either trying to hose them, or your just plain dumb. In either case they figure if they actually have to explain it you probably wouldn't get it anyway

And NO ONE can answer that question.
Statutes stipulate ranges or maximim penalties (sentence and/or fines). This gives latitude to the court to give less or more severe punishments, depending on specific facts.
Further, the sentences handed down are affected by many factors, including:
1) 'Public perception': A purse snatching where an elderly woman was injured would likely be more severe than a non-injury.
2) 'Community standards': Some communities are fed up with drug dealing and the courts could treat them more harshly than other similar crimes.
3) 'Personal factors': A court and/or prosecutor is more likely to be harsher in sentence if, for example, they had been a victim of a similar crime. Example: a judge or prosecutor who had been mugged or assaulted at some time, may deal more harshly for that crime.
4) Election: A prosecutor or judge may want to appear 'strong on crime' as election time rolls around.

Simply, there is no way that anyone, even Madam Tashia, could GUESS what might happen to your friend. They will find out at the appropriate time.

And even if we could read the future... what difference does it make??? The sentence will be whatever the court/jury decides.
