my van was vandelized while i was staying at a hotel. is the hotel libel in any way? it was an older model van and to repair it would have cost more than it was worth. it was parked in the hotels parking lot, 3 spots from the door and there was no security(cameras and otherwise).

My response:

Your van was vandalized much the same way you're vandalizing the English language with your misspelling of the word "vandelized".

Look at your hotel room rules, or the signs posted at the parking lot entrances. You are responsible for the safety of your vehicle, and a "bailment" is not created by parking - - only a license to use a parking space.

So, no - - the hotel is not liable.

There was nothing posted in the parking lot or in the hotel itself concerning the safety or security of our vehicles.

Thank your for your advice.

there was no sign! The police officer also checked in case I did not see it. I may have posted in the wrong area and my spelling may not be the best but I am far from blind or stupid.

I also thought this was a site where I could get some information. Obviously I was wrong. So far the only thing I have received was sarcasm and bad jokes.

My response:

I didn't say "in the parking lot", now did I. I said at the entrances.

You should be able to see a sign which states basically the following:

"No liability is created by granting parking or vehicle operating privileges on property owned, leased, or otherwise controlled by the [name of hotel]. The [name of hotel] assumes no responsibility for the care and/or protection of vehicles or their contents while operated or parked on [name of hotel] property. No bailment is created hereby."

It's there. I guarantee you. You just didn't look hard enough, or you didn't look at the entrances.

Why is this post in the libel/slander section?

My response:

Because, if you look carefully at her initial post, she using the "sound" of the word "libel", and thus, confusing the words "libel" and "liable" as being one in the same. So, apparently, when she saw the word "libel", she thought it was the same thing, and posted to this forum.

I knew why, IAAL. I was just waiting for the original poster to explain her reason.

My response:

Oh, well here's something more to ponder - - maybe she meant "Martha and the Vandellas". Who knows?
