Vet lost our dog and threw us out

This happened in PA.

Recently we took our female dogs to be fixed. We're tired of seperating the boys and girls when they go in heat, they get CRAZY!!! OH, I had 7 dogs, 4boys and 3girls.

Anyway, we went to our vet and had the 1 girl fixed. The next day was a pre-op checkup visit for the other 2 girls. We brought the 2 girls in and the lady took the one (CHEDDAR) to get her blood sample. I guess the lady decided she wanted to walk her before she started to check her out, like we would bring a dog inside that could potentially go to the bathroom inside. :rolleyes:

Cheddar didnt want to go out with the lady, she just sat down and stayed her ground. She had on this nice dog harness, pretty beefy for a lil 15lbs dog!! The lady kept pulling the leash harder and harder, the dog WOULD NOT budge. She kept pulling until she pulled so hard and the harness slid off of the dog. In the meantime, my wife is watching this go on out the window. As soon as the harness pops off the dog, the dog takes off! The lady tried to catch her right away but couldnt.

She now comes into the visitor area crying and tells my wife that she lost our dog. Beth immediately goes to her car and starts to drive around. The 1 vet and a secretary go out and help. Beth calls me at this point and I left work right then, 30-45 minute ride for me to get home.

I get to the vets office and asked what happened, CALMLY! She tells me, OH what SHE did was SHE uhh uhh.... I said SHE WHO? She says OH the dog. This lady tried to make it seem like it was the dogs fault She then tells me that Cheddar pulled so hard against her that she broke the harness. I couldnt believe that, a lil 15lbs dog and a BEEFY dog harness breaking is total BS.

I started to search the area for the dog. I should also add that this vet is RIGHT next to a major highway and the other roads are busy as hell too. I was terrified for my dog, she's not used to cars at all.

We seached for 2 hrs. About the first 45-1hr the vet gave up and went back. We kept searching and it began to snow HARD. We had my buddies Civic and my wifes SpecV with summer tires, we could NOT stay out in this weather with these cars. I went back to the vets office and asked why they're not out looking with us still???? She says, we dont know where to look I told her if I knew where to look, I would just go grab her!!! At this point I was full hot ready to kill people. I got quite upset in the office and demanded my money back from the day before and that I would NOT be paying for today's visit either. She looked stunned and asked why? I laughed right in her face and said ARE YOU SERIOUS!!! You think I'm actually going to pay you for this!!!! She says well everything went fine yesterday with your other dog, why shouldnt we get paid for that? She then tells me that I need to understand that dogs break harnesses and run away all the time. While she says this, she picked up the harness off of the counter and placed it down quickly. I snatched it and sure enough, THERE WAS NOTHING WRONG WITH IT AT ALL!!!! I even tried to rip the buckle apart, no matter how hard I pulled, it held. I just walked out, I was on the edge of laying this woman out. I've NEVER hit a girl but she really was about to get it!

I went outside and was talking with my wife and a couple friends that came over to help us search. The vet comes out with a check for 350, the amount of the visit the day before, hands it to me and says THERE we're even. I laughed again, took the check and told her we're NOT EVEN CLOSE to even. She then told me to get off of her property that I'm not a customer and if I dont leave ASAP she will call the police on me. I left......

Since then we have not found our dog. I filed a complaint with the state board of vets and they are NOT pursuing any action against the vet.

I talked to an attorney yesterday about filing a DJA against the vet for the limit(8k) and a public apology. Is this the best course of action for us????

This is what the attorney suggested we do. I was talking with my dad though and he says to sue for their malpractice limits. The only problem with this is, if they dont get stunned by the suit and try to settle, a judge may not take it seriously asking for so much for a dog.

I'm not money hungry, I make plenty of it. I just want it to be something that hurts the vet. I hate thinking about what has happened to us and what has happened to her, NOTHING AT ALL.. :(

You have no case. PERIOD!

I understand your anger, but the vet made amends through the refund.
There is no malpractice, the dog was not treated, therefore, the point is moot.

As BB said, it would seem you have no recourse. Do what your lawyer advises.

I should add that I'm not suing for malpractice but negligence. The lawyer said it may fall under her malpractice insurance. I'm only asking to check all options and see if what we're doing is the best possible method to get some action against this vet.

I'm not trying to sue her for malpractice. I'm trying to sue her for pure negligence and the fact that they lost her and gave up looking for her almost right away. Then threw us off of her property for being upset about it.

We're talking about a 15lbs dog here. We went to another vet recently that said she would've just picked up the dog and carried her if she wouldnt budge, not keep pulling until she goes. Thats where the problem started, she kept pulling and pulling and pulled the harness right off of the dog. Then lied to us telling us the dog broke the harness.

I'm not doubting anyone's comments, but I just have a hard time dealing with the fact a business owner can do this and act like that, and theres no consequences at all for her.....

Look at the bolded word. Then perform a search on the internet for it's definition. Nothing in your post suggests that the vet or her employees are liable for anything related to negligence.

However, if you feel differently, you are well within your rights to spend about $5,000 of your own money to bring the matter to trial and if (most likely when) you lose, you could also be taxed with the vet's legal fees and court costs.

Is it worth it?

Malpractice insurance is for damages from TREATMENT/Lack of proper treatment.
The vet looked for almost an hour, based on your own statement.
Negligence means something different than what you think it does. Look it up as suggested.

Like I said, its just very hard to deal with the fact that I cant really do anything. Maybe negligence is strong, but definately professional incompitent. Hopefully my attorney can better word this to a judge, cause I think I'm butchering it up :p

Just curious. Did you tell your attorney you were given a check and what did you do with said check?

I told the attorney about the check and told her that I deposited it too. She says that could be an issue BUT I did tell her that we are NOT even close to even. I have a couple witnesses about this situation but they can definately be viewed as biased witnesses too.

CAN be an issue? Guess what? It is the ONLY issue. The vet provided compensation, you accepted such. The matter is OVER.

Listen, I have a vet I travel more than 1,000 miles to see when 'scruffy' needs him. There is a reason for that. And each and every time I take her, there are dogs there, on leashes and muzzled. it is his requirement and just plain smart for pet owners to take ordinary care.

you did not do this. You relied on the vet to take ordinary care for your pets that you did not take yourself. and when the pet was lost, you abdicated all responsibility.

Although I hesitate to give specific determinations in this forum, if I were sitting on the bench during this trial and based solely on the facts presented, you would lose on motion for summary judgement.

What do you mean I relied on the vet for ordinary care that I did not take myself? I'm confused by what you mean by that.
