What is the name of your state (only U.S. law)? MS
I want to know if its possible to void an adoption. I let my mom and her husband adopt my daughter now she wants to come back in live with me.

When did this take place? There is only a very small window during which consent can be revoked.

Legally, you no longer have a daughter. Unless her legal parents - your Mom and her husband - allow her to come and live with you, there's nothing you can do.

If her mother and father are willing to give up their parental rights, it's possible that you could adopt the child. If they are not willing to do so, then probably not. You have zero rights to the child if she has been adopted. As far as the law is concerned, you are a stranger.

I'm not convinced the court would actually entertain this; it's incredibly confusing to the child involved.

Of course, we don't know when this took place or how old the child is now - both would be helpful.

Maybe not confusing. After all it was the grandparents who adopted her. If everyone has been honest with the child and the adoption was "open" there wouldn't be any confusion.

Since she said that the child wanted to come back and live with her, that suggests that the adoption has been open.

Legally, the child is sister to the biomom now. It is possible for a sister to be made legal guardian.


And just because kiddo WANTS to live away from her mom and dad, doesn't mean her parents agree. What a child WANTS at any given time is not necessarily what's best for them.

These answers all presume CPS was not involved in the adoption.
