i was reciently forced to completely reinstall my computer because somebody sent a virus using the send file feature on MSN Messenger that downloads and opens automatically, the person has no idea that they are sending it and some of my friends have also had to lose data becuase of it, i was just wondering if there is anything that can be done about the sender

Well, you could shoot them, hang them by their toenails or beat the crap out of them. Otherwise, what would you LIKE to do with them?

I am NOT a lawyer.

Unless you can find the creator of the virus, then no. If you can, im sure you can pursue damages or some sort. But most of the time, virus are "released" "started" from someone in the middle east (such as afganistan and the likes) or over in that direction anyways. So chances are, you probably wont find the creator. =\
