visitation change?

What is the name of your state? montana - are there forms I can just file myself to change the originial visitation. Where do I get them? Are they on line?

Hello, you should be able to go to your family court house and obtain what are called modification papers, and instruct you further.

~When my fiance' asked for the paper work at our court house they told him the same... there wasn't any such papers. They told him to just write a letter with his request and why. Then sign in front of them and they would file. Give me a couple of hours and I can let you know for sure... my fiance' is on his way there as I type (it's a little over an hour drive)!

Ok, just talked to my fiance'. He said that they gave him a form to file a petition. It just asked why the court date was being requested. He filled it out... which in our case is time of pick-up (change in work schedule) and transportation (we are asking her to make 1/2 the trip), since she now has reliable transportation and has denied us visitation multiple times in the past due to her being difficult, in return costing us money for no reason. So, unless someone else has a better idea, I would just walk in and tell them that you want to file a petition on visitation. Worth a try, it worked for us. Good luck!

That is what they told us when we called as well, and to type up the request. Then today they had him file a petition. Try it, it might work for you as well!

We can't go to the court house. We llive in Missouri and the children are in Montana. We called but got no where. Thanks for your help anyway.

Does that particular court system have a mediation process? If so, perhaps you could contact the mediator to see if something could be started on that end. It's worth a try

If you're not in the same state, it's going to be difficult to get anything done without an attorney.

Stealth is right, seek out an attorney and go that route beings that you live out of state. It might be more costly but after all it is a child. Good luck!

Try my tactic

I get tired of the whole "right to represent yourself" thing, and then no cooperation from the legal system to allow you to do so. Montana is probably a lot like Idaho, that's where I am. Get on the computer, go to word perfect,and type in your case no., name, address, all pertinent info. Title the page "Motion to Modify Custody" and state your case. Sign it, maybe get it notarized (your courthouse should be able to give you a list of notaries), at least get it witnessed, call the courthouse in Montana and ask how much it costs to file a motion on an exhisting case. Then send it to them. They will let you know (usually) if it is acceptable. If not, tell them you need the format that will make it acceptable. If you're persistant, eventually they'll get sick of you and just give you the info. you need. They can't accept your money unless the judge approves the motion.
