If a father fom another state wants his son to visit him at what age must the mother let the son go? They were never married but father is paying child support because state of Florida went after him for it not the mother. Father has a history of violents.

My response:

What does the court order state concerning visitation ?

If there is no court order, absolutely do not let that child go across State lines. If you do, you may never see that child again. That's because without court orders, either parent may legally "keep" the child.

A court order for visitation will be the only thing that will protect your rights to the child, and will give you leverage with the courts and police authorities should something "go wrong" with the out of State visitation.

So, in short, unless you have court orders, do not allow any out-of-State visitation. Remember the milk carton pictures ?

Still seeking advice...information ...on Is there an age that a parent can have visitation right if that parent lives out of state? Child has always been with mother. Father never showed interest until child was one year old, then he was married to someone esle, never married child's mother. Remember he pays child support because the state of Florida went after him not the mother of child. Mother lives in Florida, father lives in Tennessee. I believe father has court order for visitation rights with the Tennessee courts not Florida. Child was born and lives in Florida never been in the state of Tennessee.

My response:

I can't answer your question regarding "age" of a child to satisfy visitation out of State. It would be a simple matter to call a Family law attorney in Florida and ask the question.

However, I can tell you this: If the child has never been to Tennessee, then that States' courts could NEVER have given the father visitation rights. That's because Tennessee does not have "judisdiction" over that child - - Florida has jurisdiction.

If the father wants visitation, then he MUST file a Petition in the State of Florida.

Please take heed of the information in my earlier response. Unless there are court orders for visitation, NEVER let that child out of mother's sight.

I received word last night that the father has filed a Petition in the State of Florida for visitation. It is ashame that a young child of two must go to a place he does not know with a man he does not know. "THAT'S JUSTICE??????"

My response:

No, that's the law. The law requires that a child and parent get to know each other, and have an ongoing relationship. And, at what better age than near the beginning of life for this to happen? Courts encourage familiar relationships, and you would be well-advised to allow such a relationship to flourish. Otherwise, you and mother might have some explaining to do in front of a judge.

You know, I've been right so far with you, and if I were you, I'd keep listening and understanding - - or you're bound to be bumping heads over this for years to come. Lots of attorney fees and costs down the drain in fighting an uphill battle.

You are more likely to be able to help your child adjust if you work with him/courts etc.. If you flat out refuse then you are heading for a lot of pain.. but there is nothing to stop you suggesting a schedule that builds up to a trip to TN.

Thank you for your replies and advice. I am just concerned for the well being of the minor child. He is so happy go lucky now and I do not want anything to change that. All I can do now is pray all goes well.
