What is the name of your state? New Hampshire.... How old does my stepson have to be before he can stay here...He lives in Missouri and he told his father before school got out that he wanted to live with us..My husband has him for the summer...He is 14 1/2 he told his teachers and his guidance counslor that he was coming to live here..He has it rough out in mo. We pay support for him and is 2 older brothers but it looks like they live very poor...Can he just stay here or do we have to take him back..He says he is not going back..

If his mother has court-ordered custody, you must return him. The only option is for Dad to file for a modification of custody, but it's unlikely he'd get it into court before the end of the summer.

When the childs father does go to court to change the custody since the child is 14 he could also consent to the move as well.

If you're trying to say that the child could consent to the change in custody, that's true - to a point. He will likely have the ability to tell the judge his wishes, but it will be up to the judge to decide how much weight to give to those wishes. The judge is the one who will decide where the boy lives.

Yeah that is why i pust "as well" meaning there would be other people consenting ;) His opinion is counted because of his age.

At the discretion of the court. If his only reason is because they "live poor", a judge is unlikely to give it a great deal of weight and may well just increase Dad's supprot obligation.

No but if they could prove hes not living well there they might have a chance. I was just letting them know if they wanted to get the child involved they could because the age of consent in New Hampshire is 14 if the judge feels that its nescesary. The jugde could ask the child questions as to why he thinks it would be better for him to live with father rather than mother. Anything could happen.

Well i hope they don't raise it...Maybe his mom just usees the money for other stuff and theres nothing we can do...she pays no rent she has no cable and no phone so the kids can't call him.We send them all kinds of stuff..The father didn't even get a chance to have any of his sons come live with us...The just figure the mom should have them..RIGHT..Wheres the justice when it came to these kids..She didn't want them but she didn't want the dad to have them..They live out in the hicks and nobody nos what is going on out there...
