My state is New Mexico.
My brothers ex and him used to live together and had a baby. Before he turned one she stopped letting him see his son and it took over a year to get even supervised visitiations. Those are done with now but he doenst get to see his son but maybe 2 or 3 days of the whole month. What are the steps he needs to take to get set visitations every week? And is there any legal help in the state of Southern New Mexico that can help us because we don't have very much money? And is it ok for him now to go to the school (preschool/elementary) and ask the teachers of his status and grades or report cards. His childsupport is all ready set at 400 because they lied in court and he is paying back pay along iwth a 350 set child support.
If anyone knows anything good to pass one it would be greatly appreciated.
 


You need to file for visitation and/or custody. It IS your brother's right to see his child and there isn't much the biomom can do about it. It'll be court-ordered and if any of the parents fail to comply, they could be found in contempt. Also, make sure you brother gets every detail in the filing as well (the 'who's/what's/when's/where's,' etc)

Try legal aid for assistance. I am not sure if all legal aid's help out with family law issues. YOu might want to have your brother call the local CSEA and see what steps need to be taken or even do some research online (state resources, etc).
