ks - my ex and i recently divorced and agreed that he would pick our son up from daycare 3 days a week and keep him until 6:30. The problem is that i recently moved about 20 minutes away from him. i asked him to meet me halfway so i did not have to drive all the way to his house and back. at first, he was agreeable, but has since thrown a "temper tantrum" and now refuses to meet me at the agreed upon point. i know that things should have been stated in writing now, such as days and times, so what are my options at this point? i am a young single mother with limited funds and i need the most cost effective solution possible! he also repeatedly picks our son up on days other than agreed upon, and keeps him past times other than agreed upon. help!!!

You could file contempt charges on him for going outside the visitation schedule, and petition for modification of visitation or custody (whichever is required) to state days and times of visitation. You could file the papers yourself. Call the Clerk of Courts where the divorce was settled and ask what papers you need and where you can find the forms. Then, if possible, have a paralegal look over the papers for accuracy. Just a suggestion.

Is your income concidered low? Check and see if your state offers free legal help for those on low income. I live in PA and my state does. But I am not concidered low income.:( BUt if your state does don't feel ashamed for help! Hey we all need it from time to time. Good Luck to you!

However it is stated in the decree is what you refer to if an alternative arrangment cannot be made. Initially, does he pick the child up from daycare, and then you pick the child up from his home at 630pm? If so, you are solely responsible for picking that child up. You are the one that moved 20 miles away, not him.

So pretty much it just depends exactly what the court order says.
