Wage Garnishment

What is the name of your state? Illinois

A friend and I decided to get an apartment together about a year ago but then I decided not to. My name was on the lease but I never signed it because I never planned on living there, which I didnt. My friend never paid her rent and now creditors are trying to garnish my wages for the amount owed. How can they do that if I never signed or even put my intials on the lease?

Have you checked just to see for your self if there ever was a judgment? you can do so by looking up your name at the county court offices of the county the rental unit is in .

They already took us to court once. The only reason I went is because if I didnt I was afraid they would arrest me or something. I just thought that unless my signature is on the lease, it isnt binding in any way! I think the collection agency is telling me a story but I dont really know. I would think that the judge would make sure there was a signature on it before he signed a wage garnishment but I dont know!

Tiff take some time to read postings in the last few days inthe thread credit and collection on this board there you will see the same basic things to do to stop this collector If your LL allready lost court case but turned to collector anyway .

You MUST check the court records now...it sounds like you were in court and may have defaulted in one way or another. IMMEDIATED ACTION is required...find out the facts and see what the written COMPLAINT that may have been filed against you says and alleges. If you were named as a defendant and served and failed to respond, you have a problem and if such is the case, get a lawyer, NOW!
