State of Indiana - If the biological father waives his rights and the step-father adopts the children, does the biological father still have to pay child support?What is the name of your state (only U.S. law)?

If the father's parental rights are terminated and the stepfather adopts the child, then the original Dad is no longer responsible to pay CS. However:

1. He would need to go to court to have CS terminated
and
2. This would not erase any arrears

CS can be terminated as part of the action to terminate his parental rights if the case is handled properly.

On the arrears - What if I agreed that the biological parent didn't have to pay any arrears? Does that have to go to a judge to decide, or is that just the way it is? Thank you for assistance.

If all of the arrears are owed to you, and none of them are owed to the state, you can agree to that if you so choose.

Is that money owed to you or to the state? If it's owed to the state, then the state would have to agree to drop it. If it's owed to you, you can agree.

have you ever collected state aid on behalf of the child? if so, what type of aid?

I don't believe so. I had triplets, and my daughter received some SSI checks because she had low birth weight. I'm not sure if that is state or federal????

State aid would be food stamps, tanif, medicaid, section 8 housing etc.
